Swoop Terms of Service

The short version: Use Swoop to reply to your own missed calls, not for marketing blasts. Pay your monthly fee. Don't break the law. We'll do our best to keep the service running but can't guarantee perfect uptime.

1. Who these terms are between

These Terms of Service ("Terms") govern your use of Swoop, an SMS auto-reply service offered by WelcomeMat Digital LLC ("WelcomeMat", "we", "our"), a limited liability company based in Sammamish, Washington. "You" or "Subscriber" means the business that has signed up for Swoop.

By signing up for or using Swoop, you agree to these Terms.

2. What Swoop does

Swoop monitors your business phone line, detects missed inbound calls, and sends an automated SMS reply to the caller from a phone number provisioned for your business. An AI assistant continues the conversation and surfaces the resulting lead to you in the Swoop dashboard.

5. Pricing and payment

Swoop is offered on a monthly subscription. Pricing is shown on the Swoop product page and on your dashboard. Fees are billed in advance each month. You can cancel at any time; cancellations take effect at the end of the current billing period and do not entitle you to a prorated refund.

Founding-cohort pricing (where applicable) is a lifetime price as long as your subscription remains continuously active. If you cancel and re-subscribe, current standard pricing applies.

6. SMS message rates

Your customers may incur message and data rates from their mobile carrier when receiving or replying to Swoop messages. WelcomeMat does not control these rates.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. SMS delivery depends on third-party carriers (notably Twilio) and is not guaranteed within any specific time window. Swoop is provided "as is" without warranties of any kind, express or implied, except as required by law.

8. Limitation of liability

To the maximum extent permitted by law, WelcomeMat's total liability for any claim arising out of or related to Swoop is limited to the amount you paid for Swoop in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost business opportunities.

9. Termination

You may terminate your subscription at any time from the dashboard. We may suspend or terminate your account for non-payment, violation of these Terms, or as required to comply with law or carrier rules. On termination, you lose access to the Swoop dashboard; data retention follows our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or via the Swoop dashboard at least 14 days before they take effect. Continued use of Swoop after that period constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in King County, Washington.
